Website Usage

We do not allow any illegal material to be stored on our servers (e.g. audio, video, software or text that breaches any copyright, or material in violation of any UK legislation). We do not allow any pornography, erotic images or otherwise obscene content.

Art Work

Artwork supplied by us may have license restrictions. You must contact us before re-using any artwork on other websites or printed material.

Website Hosting

Our website hosting is aimed at small companies that require an online presence in return for a low investment. By using our hosting service you agree to our 'High Usage Policy'. If a website is producing too much load on our servers and having a detrimental effect on other hosted websites, or proving to be financially draining on Contrast Web Solutions, we reserve the right to stop hosting the website with immediate effect. In this scenario, you should organise hosting with another provider. We will help transfer the website to the new hosting provider free of charge.

We retain the ownership of the software we have created to operate your website. You may not use our software to create and operate websites without our permission. You agree not to make changes to our software. We do not claim ownership of any text and images you upload to our servers.

We reserve the right to suspend or cancel your access to any or all of our services where we decide that the website has been inappropriately used. We reserve the right to refuse service and /or access to our servers to anyone.

Domain Names

We may register a domain name for your website at your request. By making this request you will enter into a contract of registration with Nominet UK under the terms and conditions displayed on the following web page: http://www.nominet.org.uk/nominet-terms. This is a separate contract to any arrangement you have with us. Please read this before requesting us to supply your domain name.

When registering a domain name we will also set up Google Apps to provide free email addresses to use with your domain name. You will enter into an additional contract with Google which can be viewed here: http://www.google.com/a/help/intl/en/admins/terms.html. If you do not want us to configure this free service for you, please let us know when you request the domain name to be registered.

You will be the legal owner of any domain name we register on your behalf. We do not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership. You agree to indemnify us from any legal proceedings and costs that arise as a result of the registration of a domain name.

We will request domain name renewal fees well in advance of their expiry. If you do not complete the required payment before the expiry date, the domain name will not be renewed and may become unavailable to you.

At your request, we will transfer the administration of the domain name to your chosen service provider. This will allow you to continue using the domain name if you create a replacement website.

Refunds cannot be given for the cost of registering domain names . Please ensure you provide us with the correct spelling.

Indemnification

You agree to defend, indemnify, save and hold Contrast Web Solutions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against us, our customers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you, your agents, employees or assigns. You agree to defend, indemnify and hold harmless Contrast Web Solutions against liabilities arising out of; any material supplied by you infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement and any defective products sold to customers from our servers.

Communication Policy

All communication between you and Contrast Web Solutions is for the sole use of the intended recipient. Any viewing, copying or distribution of, or reliance on this communication by unintended recipients is strictly prohibited. If you have received communication in error, please notify us immediately and delete it from your computer. You agree to receive occasional emails from us with respect to the services we are providing to you.

Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We cannot guarantee to be able to replace lost data. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Contrast Web Solutions and our employees. We reserve the right to revise our policies at any time.
